為建設知識產權強國夯實人才基礎

  習近(jin)平總書記指(zhi)出(chu):“保(bao)護知識(shi)產(chan)權(quan)就是保(bao)護創新。全面建設社(she)會主(zhu)義現(xian)代化(hua)國(guo)(guo)家(jia),必須更好推進知識(shi)產(chan)權(quan)保(bao)護工作(zuo)。”中共中央、國(guo)(guo)務院(yuan)印發的《知識(shi)產(chan)權(quan)強(qiang)國(guo)(guo)建設綱要(2021—2035年)》提出(chu),要“加強(qiang)教育引(yin)導、實踐(jian)養(yang)成和制度保(bao)障,培(pei)(pei)養(yang)公民自覺尊重和保(bao)護知識(shi)產(chan)權(quan)的行為習慣”。應認真(zhen)分(fen)析(xi)知識(shi)產(chan)權(quan)人才(cai)培(pei)(pei)養(yang)現(xian)狀,摸索知識(shi)產(chan)權(quan)人才(cai)培(pei)(pei)養(yang)規(gui)律,優化(hua)知識(shi)產(chan)權(quan)人才(cai)培(pei)(pei)養(yang)機(ji)制,為知識(shi)產(chan)權(quan)強(qiang)國(guo)(guo)建設夯實人才(cai)隊伍(wu)基(ji)礎。

 

  

 

  改革開放以(yi)來,我(wo)國知(zhi)識(shi)產權人(ren)才(cai)(cai)培(pei)養取得了巨(ju)大成績,但一些領域仍存(cun)在(zai)(zai)不足(zu)之(zhi)處(chu)。概括而言,主要表(biao)現(xian)在(zai)(zai)知(zhi)識(shi)產權人(ren)才(cai)(cai)儲備(bei)、知(zhi)識(shi)產權人(ren)才(cai)(cai)隊(dui)伍(wu)知(zhi)識(shi)結構、知(zhi)識(shi)產權人(ren)才(cai)(cai)職稱評價體系等方面。

 

  知(zhi)識(shi)(shi)產(chan)(chan)權人才儲(chu)備(bei)(bei)。知(zhi)識(shi)(shi)產(chan)(chan)權人才教育是知(zhi)識(shi)(shi)產(chan)(chan)權強(qiang)國(guo)建(jian)設的基礎。當前,我國(guo)知(zhi)識(shi)(shi)產(chan)(chan)權人才隊伍(wu)約(yue)有(you)70萬人,但對于我們(men)這樣一(yi)(yi)個大國(guo)來說,精(jing)(jing)通(tong)(tong)知(zhi)識(shi)(shi)產(chan)(chan)權法律(lv)(lv)、精(jing)(jing)通(tong)(tong)用(yong)知(zhi)識(shi)(shi)產(chan)(chan)權來引(yin)導創(chuang)新(xin)(xin)布局、精(jing)(jing)通(tong)(tong)知(zhi)識(shi)(shi)產(chan)(chan)權管控與運營、精(jing)(jing)通(tong)(tong)知(zhi)識(shi)(shi)產(chan)(chan)權國(guo)際(ji)事(shi)(shi)務的復合型人才儲(chu)備(bei)(bei)總量還(huan)遠(yuan)遠(yuan)不能滿(man)足知(zhi)識(shi)(shi)產(chan)(chan)權強(qiang)國(guo)建(jian)設的需要。實踐(jian)中,由于高水平人才的欠缺(que),知(zhi)識(shi)(shi)產(chan)(chan)權制(zhi)度(du)服務創(chuang)新(xin)(xin)需要、引(yin)導創(chuang)新(xin)(xin)活(huo)動(dong)、塑造(zao)創(chuang)新(xin)(xin)方向(xiang)的功(gong)能還(huan)難以(yi)充分發(fa)揮。國(guo)內知(zhi)識(shi)(shi)產(chan)(chan)權服務業往往還(huan)處于低端價格競爭的層次,例如,一(yi)(yi)些(xie)大型企業每年需要花費巨額費用(yong)聘請海(hai)外(wai)知(zhi)識(shi)(shi)產(chan)(chan)權律(lv)(lv)所或(huo)事(shi)(shi)務所來撰寫海(hai)外(wai)專(zhuan)利申請案或(huo)其他業務。

 

  知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)人才隊伍知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)結構。高(gao)校(xiao)是知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)人才培(pei)養(yang)的(de)(de)(de)主要陣地。當前(qian),我國有50多所(suo)高(gao)校(xiao)建(jian)立了知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)學(xue)(xue)院,上百所(suo)高(gao)校(xiao)開(kai)設了知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)專(zhuan)(zhuan)(zhuan)(zhuan)業(ye)。但是,隨著科(ke)(ke)技創新與(yu)經(jing)濟社會(hui)(hui)發展(zhan)融合(he)度越來越高(gao),對知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)人才的(de)(de)(de)專(zhuan)(zhuan)(zhuan)(zhuan)業(ye)技能(neng)也提出了更高(gao)要求。目前(qian),我國高(gao)校(xiao)知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)學(xue)(xue)科(ke)(ke)建(jian)設存在學(xue)(xue)科(ke)(ke)結構不(bu)合(he)理、人才培(pei)養(yang)方(fang)向與(yu)社會(hui)(hui)需(xu)求不(bu)相匹配等問題。例如(ru),在過去(qu),社會(hui)(hui)對知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)人才的(de)(de)(de)技能(neng)需(xu)求主要集(ji)中(zhong)在專(zhuan)(zhuan)(zhuan)(zhuan)利(li)商標申請和法(fa)律訴訟兩大領(ling)域(yu),而今(jin)天,則對通過知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)信息分析(xi)引領(ling)技術創新布局、知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)經(jing)營管理與(yu)金(jin)融融資、知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)國際事務(wu)處理等方(fang)面的(de)(de)(de)能(neng)力(li)提出更高(gao)要求。在當前(qian)的(de)(de)(de)學(xue)(xue)科(ke)(ke)建(jian)設中(zhong),普遍將知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)作(zuo)為二級(ji)學(xue)(xue)科(ke)(ke)置(zhi)于(yu)法(fa)學(xue)(xue)一級(ji)學(xue)(xue)科(ke)(ke)之下,這使得(de)培(pei)養(yang)出來的(de)(de)(de)學(xue)(xue)生絕大多數只適(shi)應與(yu)法(fa)學(xue)(xue)有關的(de)(de)(de)版權(quan)(quan)(quan)(quan)、商標等業(ye)務(wu),而對技術含量更高(gao)的(de)(de)(de)專(zhuan)(zhuan)(zhuan)(zhuan)利(li)等業(ye)務(wu)少(shao)有涉獵,普遍處于(yu)一種(zhong)先天性(xing)的(de)(de)(de)專(zhuan)(zhuan)(zhuan)(zhuan)業(ye)偏差(cha)狀態,難以勝(sheng)任除法(fa)律以外(wai)的(de)(de)(de)知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)經(jing)濟、管理、金(jin)融、外(wai)交等業(ye)務(wu)。知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)機構在招收人才時,往往只能(neng)從理工、農(nong)林等專(zhuan)(zhuan)(zhuan)(zhuan)業(ye)學(xue)(xue)生中(zhong)尋找,然后重新進(jin)行知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)(quan)(quan)(quan)法(fa)學(xue)(xue)基礎(chu)知(zhi)(zhi)(zhi)(zhi)識(shi)(shi)的(de)(de)(de)培(pei)養(yang)。

 

  知識(shi)(shi)產(chan)(chan)(chan)權(quan)人(ren)才職(zhi)稱(cheng)評(ping)價體(ti)系(xi)。目前,我國知識(shi)(shi)產(chan)(chan)(chan)權(quan)人(ren)才主(zhu)要分布在(zai)各(ge)類(lei)型企(qi)業(ye)、知識(shi)(shi)產(chan)(chan)(chan)權(quan)代理機(ji)構(gou)(gou)、知識(shi)(shi)產(chan)(chan)(chan)權(quan)行政管理與(yu)司法執法機(ji)構(gou)(gou)、各(ge)類(lei)型高校(xiao)和科研(yan)院所中。知識(shi)(shi)產(chan)(chan)(chan)權(quan)專(zhuan)業(ye)人(ren)員在(zai)高校(xiao)中獲得職(zhi)稱(cheng)一(yi)(yi)般(ban)歸入(ru)各(ge)自一(yi)(yi)級學(xue)科門類(lei)之下,如(ru)法學(xue)、經濟學(xue)、管理學(xue)等。對于廣大企(qi)事業(ye)單位(如(ru)企(qi)業(ye)、知識(shi)(shi)產(chan)(chan)(chan)權(quan)代理機(ji)構(gou)(gou)等)中的(de)知識(shi)(shi)產(chan)(chan)(chan)權(quan)專(zhuan)業(ye)人(ren)員來說(shuo),則缺(que)乏(fa)相應職(zhi)稱(cheng)評(ping)價體(ti)系(xi)。2019年,知識(shi)(shi)產(chan)(chan)(chan)權(quan)專(zhuan)業(ye)開始有了(le)自己(ji)的(de)職(zhi)稱(cheng)序列(lie),但是(shi)各(ge)地(di)還缺(que)乏(fa)對知識(shi)(shi)產(chan)(chan)(chan)權(quan)師職(zhi)稱(cheng)評(ping)價的(de)專(zhuan)門機(ji)構(gou)(gou),也缺(que)乏(fa)進行準確評(ping)價的(de)標準體(ti)系(xi),使(shi)得這一(yi)(yi)制(zhi)度還難以發揮在(zai)知識(shi)(shi)產(chan)(chan)(chan)權(quan)人(ren)才隊伍建設中的(de)應有作用。

 

  

 

  建設(she)(she)(she)中(zhong)國特色、世界(jie)水平(ping)的(de)知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)強國,是以習近平(ping)同志為核心(xin)(xin)的(de)黨(dang)中(zhong)央作(zuo)出的(de)重大(da)戰(zhan)略部(bu)署。深入(ru)實施知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)強國戰(zhan)略,全力做好(hao)新時代(dai)知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)工(gong)作(zuo),能(neng)夠更好(hao)服務構建新發(fa)(fa)展(zhan)格局(ju)、推(tui)動高(gao)質量發(fa)(fa)展(zhan),對于提升國家核心(xin)(xin)競(jing)爭力、擴大(da)高(gao)水平(ping)開放(fang)具有重要(yao)意義。知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)人(ren)(ren)才(cai)(cai)隊伍(wu)的(de)培(pei)養(yang)(yang)與建設(she)(she)(she)是知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)強國建設(she)(she)(she)的(de)重要(yao)基礎。培(pei)養(yang)(yang)一流知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)人(ren)(ren)才(cai)(cai),應當以學科體系(xi)(xi)建設(she)(she)(she)為引領,準確界(jie)定(ding)知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)人(ren)(ren)才(cai)(cai)應具有的(de)基本(ben)素質,盡(jin)快完善知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)學科體系(xi)(xi)和專業課程(cheng)設(she)(she)(she)置,構建更為合理的(de)職(zhi)稱評價體系(xi)(xi),進而(er)營(ying)造更加開放(fang)、更加積極、更有活力的(de)知(zhi)(zhi)識(shi)產(chan)(chan)(chan)權(quan)(quan)人(ren)(ren)才(cai)(cai)發(fa)(fa)展(zhan)環境。

 

  精準界定(ding)知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)人才(cai)(cai)(cai)培(pei)養目標。新(xin)形勢(shi)新(xin)需要(yao)對(dui)知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)人才(cai)(cai)(cai)提出(chu)了(le)新(xin)要(yao)求。第一,培(pei)養具有創(chuang)(chuang)(chuang)新(xin)能力的(de)(de)人才(cai)(cai)(cai)。專利中(zhong)的(de)(de)創(chuang)(chuang)(chuang)造(zao)性(xing)、版權(quan)(quan)(quan)中(zhong)的(de)(de)獨創(chuang)(chuang)(chuang)性(xing)等,要(yao)求知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)人才(cai)(cai)(cai)不能滿足于普通思考(kao),而應不斷超越自(zi)我,通過(guo)提升創(chuang)(chuang)(chuang)新(xin)能力探索未(wei)(wei)知(zhi)(zhi)世(shi)界、創(chuang)(chuang)(chuang)造(zao)知(zhi)(zhi)識(shi)(shi)價值。第二(er),培(pei)養具有綜合素質的(de)(de)人才(cai)(cai)(cai)。知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)的(de)(de)創(chuang)(chuang)(chuang)新(xin)活(huo)動建立在(zai)了(le)解(jie)人類已有知(zhi)(zhi)識(shi)(shi)基礎之(zhi)上,能夠(gou)對(dui)技術的(de)(de)必然性(xing)趨勢(shi)做出(chu)預(yu)測(ce)并提前(qian)布局。這(zhe)就要(yao)求知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)人才(cai)(cai)(cai)具有技術創(chuang)(chuang)(chuang)新(xin)、經濟管理(li)等綜合素養,能夠(gou)在(zai)法律規(gui)范(fan)之(zhi)下將技術創(chuang)(chuang)(chuang)新(xin)規(gui)律與市場競爭規(gui)律匹配,引導(dao)創(chuang)(chuang)(chuang)新(xin)活(huo)動有效展開。第三,培(pei)養面(mian)向未(wei)(wei)來(lai)的(de)(de)人才(cai)(cai)(cai)。知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)尤其是商標中(zhong)的(de)(de)利益(yi)歸屬機制,使得商業信用本(ben)身(shen)成為可以帶來(lai)收益(yi)的(de)(de)財產(chan)(chan)(chan),這(zhe)要(yao)求知(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)權(quan)(quan)(quan)人才(cai)(cai)(cai)將眼光放(fang)在(zai)未(wei)(wei)來(lai)收益(yi)之(zhi)上。

 

  建(jian)立知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)一(yi)(yi)級學(xue)(xue)科(ke)。可在一(yi)(yi)些具(ju)有學(xue)(xue)科(ke)學(xue)(xue)位自主審核(he)資(zi)格(ge)且有知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)培養基礎的(de)高校,嘗(chang)試自主設(she)置知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)交叉學(xue)(xue)科(ke),按(an)一(yi)(yi)級學(xue)(xue)科(ke)管(guan)理(li)。國務院(yuan)學(xue)(xue)位委員會、教(jiao)育部(bu)印(yin)發的(de)《研究生(sheng)教(jiao)育學(xue)(xue)科(ke)專(zhuan)業目(mu)錄(2022年)》新(xin)設(she)知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)碩士(shi)專(zhuan)業類別(bie),就是(shi)一(yi)(yi)個很好的(de)先例(li)。在經過一(yi)(yi)段時間的(de)探索(suo)之(zhi)后,建(jian)立起知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)一(yi)(yi)級學(xue)(xue)科(ke),推動高等院(yuan)校向知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)學(xue)(xue)科(ke)投入資(zi)源與(yu)(yu)(yu)人才。同時,改革完善知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)專(zhuan)業課(ke)(ke)程設(she)置與(yu)(yu)(yu)教(jiao)材(cai)體系。突破(po)原有的(de)偏法學(xue)(xue)課(ke)(ke)程設(she)置模式,擴充知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)核(he)心課(ke)(ke)程中理(li)工基礎知識、技術創(chuang)新(xin)管(guan)理(li)、知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)市場(chang)營銷與(yu)(yu)(yu)管(guan)理(li)、知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)經濟(ji)與(yu)(yu)(yu)金融(rong)、知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)統計預測、知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)外交事務等課(ke)(ke)程的(de)占比,以適應新(xin)形(xing)勢下對(dui)知識產(chan)(chan)(chan)權(quan)(quan)(quan)(quan)(quan)(quan)專(zhuan)業知識復合化、綜合性的(de)需要。

 

  健(jian)全知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)價體系。一是盡(jin)快(kuai)明確知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)的(de)機(ji)(ji)構。可以采取兩(liang)種方(fang)案:在各地(di)人力(li)資源和社(she)會保障局所設職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)委員(yuan)會中(zhong),單獨(du)設立(li)知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)專(zhuan)業(ye)(ye)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)委員(yuan)會或(huo)專(zhuan)家小組,為(wei)社(she)會提供(gong)知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)專(zhuan)業(ye)(ye)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)工(gong)作(zuo);由(you)人社(she)部(bu)門(men)委托有(you)(you)資格的(de)高校、科(ke)研機(ji)(ji)構或(huo)社(she)會團體代為(wei)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)。二是盡(jin)快(kuai)出臺知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)有(you)(you)關(guan)(guan)的(de)評(ping)(ping)(ping)(ping)價辦法(fa)與(yu)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)標(biao)準。由(you)于(yu)知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)還是一個新領域(yu),尚未有(you)(you)足夠的(de)經驗積累(lei),因(yin)此,應盡(jin)快(kuai)由(you)人社(she)部(bu)門(men)出臺知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)有(you)(you)關(guan)(guan)的(de)評(ping)(ping)(ping)(ping)價辦法(fa)與(yu)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)標(biao)準,為(wei)知(zhi)(zhi)(zhi)識(shi)(shi)產(chan)(chan)(chan)(chan)權(quan)職(zhi)(zhi)稱(cheng)(cheng)(cheng)評(ping)(ping)(ping)(ping)審(shen)(shen)(shen)(shen)工(gong)作(zuo)提供(gong)具體可操(cao)作(zuo)的(de)規范。
